In this work, the author seeks to demonstrate, through concrete cases, that custom in the construction sector (Lex Constructionis) is increasingly embedded in Public Administration. To the point of being recognized as a supplementary normative source in public works contracts by the Public Procurement Law itself, overcoming the idea that custom has no place in Public Law. Likewise, the author argues that custom in the construction industry has in no way undermined the principle of legality that governs public works contracts, but rather has nourished and strengthened it for the benefit of the public interest and the administered parties, who are, ultimately, the end-users of public infrastructure.
